Terms of Use

These terms of use govern your use of our website – www.multihome.in. By accessing and using the services provided by MultiHome (“By MultiGroup”) through its website, you agree to comply with and be bound by these terms and conditions of use. If you do not agree to these terms, please do not use the website. By using the website, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

Pursuant to the Information Technology Act, 2000, these terms and conditions, including any amendments or updates, constitute an electronic record. Users agree that their use of the website and acceptance of these terms through electronic means is equivalent to a physical signature. Users acknowledge and agree that any electronic communication, including but not limited to acceptance of terms, agreements, notices, or disclosures, satisfies any legal requirement that such communication be in writing.

Description of Services

By means of its website, MGroup (MultiGroup) grants users access to a diverse range of resources and services. These services encompass activities such as listing the user’s property for rental or lease, posting requirements for a house or property for rental or lease. The services, inclusive of any updates, enhancements, new features, or the introduction of additional websites, are governed by these terms. The services include property listings, providing platform, agency services, interior services, FMS-BMS services and many others. Some of them are listed out below. Users (as defined below) agree that for availing the services separate agreements will need to be entered into with MGroup (MultiGroup) and/or relevant third parties. The agreements shall contain amongst others commercials, rights, responsibility, obligations and liabilities of parties.

Platform Services

  1. MGroup (MultiGroup) operates the website to facilitate connections between individuals or entities seeking to rent or sell properties (“Users”). In such cases, MGroup (MultiGroup) acts solely as an intermediary and is not a party to any rental or sale agreements. The agreement will be between the buyer/renter and the seller/property owner.
  2. MGroup (MultiGroup) provides a platform for Users to create property listings, view listings, and communicate with each other. MGroup (MultiGroup) does not participate in the negotiation, execution, or enforcement of any rental or sale agreements.
  3. MGroup (MultiGroup) provides communication tools to enable Users to connect and communicate with each other. However, MGroup (MultiGroup) is not responsible for the content of communications or the outcome of any transactions between Users.

Users acknowledge that in relation of provision of certain services, MGroup (MultiGroup)’s role could be limited to providing merely a platform for property listings and connecting Users, and MGroup (MultiGroup) would have no control over the quality, safety, or legality of the properties listed. In such cases,  if and when the User chooses to avail the rental agreement services, the User and the concerned property owner shall enter into the relevant agreement. For the purposes of this Agreement, the User and concerned property owner shall undertake:

(a) to not hold MGroup (MultiGroup) liable for any dispute that may arise between them, at any time;

(b) to not hold MGroup (MultiGroup) liable for any loss or damage that either the User or the concerned property holder may suffer or incur.

Property Listings

  1. Users are solely responsible for creating and managing their property listings on the website. MGroup (MultiGroup) does not endorse or verify the accuracy, completeness, or legality of the listings. MGroup (MultiGroup) is not involved in the payment process or the transfer of property ownership.
  2. MGroup (MultiGroup) reserves the right to remove or modify any listing that violates these terms and conditions or its policies or applicable laws.

Agency Services

MGroup (MultiGroup) reserves the right to list properties on its own behalf or in partnership with the builder or owner on the platform or get third party agents to list properties on its behalf. In the event of any of the above scenarios, the following provisions shall apply:

  1. Commission Agreement: If a User chooses to rent or purchase a property listed by MGroup (MultiGroup), the User acknowledges and agrees that MGroup (MultiGroup) shall be entitled to a commission, as agreed upon between MGroup (MultiGroup) and the User, or as specified in a separate commission agreement between the parties. Further, in such a scenario, MGroup (MultiGroup) shall also be entitled to a commission by the property owner/builder subject to the agreement between the parties.
  2. User’s Consent: By engaging in any rental or purchase transaction with MGroup (MultiGroup) for a property listed by MGroup (MultiGroup), the User consents to MGroup (MultiGroup) acting as both the listing agent and the agent representing the User in the transaction, and acknowledges that MGroup (MultiGroup) may receive a commission from both the User and the property owner or other relevant parties.
  3. Conflict of Interest Disclosure: MGroup (MultiGroup) shall disclose to the User any potential conflicts of interest arising from its dual role as the listing agent and the agent representing the User in the transaction. The User acknowledges and accepts such disclosure.
  4. Independent Legal Advice: The User is encouraged to seek independent legal advice before entering into any rental or purchase transaction with MGroup (MultiGroup) for a property listed by MGroup (MultiGroup), especially considering MGroup (MultiGroup)’s dual role in the transaction.
  5. Indemnification: The User agrees to indemnify, defend, and hold harmless MGroup (MultiGroup) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to any rental or purchase transaction entered into with MGroup (MultiGroup) for a property listed by MGroup (MultiGroup).

Role of MultiHome Group

MGroup (MultiGroup) is not a real estate agency and does not participate in the actual transaction between buyers/renters and sellers/landlords. MGroup (MultiGroup) is not a party to any transaction between the seller and the buyer. We act solely as an intermediary to facilitate communication and transactions between users of our platform. Users are solely responsible for negotiating and entering into agreements for the sale or rental of properties.

User Responsibilities

  1. Users are solely responsible for conducting their own due diligence before entering into any transaction. This includes verifying the accuracy of property information, checking the legal status of the property, and ensuring compliance with all applicable laws and regulations.
  2. Users agree not to use the website for any illegal or unauthorized purpose.
  3. Posting or transmitting any material through the website that violates or infringes upon the rights of others, is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, or otherwise objectionable is strictly prohibited.
  4. Any material that encourages conduct constituting a criminal offense, leading to civil liability, or violating any law is not allowed. MGroup (MultiGroup) reserves the right to prohibit any user conduct, at its discretion, that restricts or inhibits other users from using or enjoying the website.
  5. Users are forbidden from using the website for advertising or engaging in any commercial solicitation, including but not limited to soliciting users to subscribe to other online information services that compete with MGroup (MultiGroup).
  6. Users are responsible for maintaining the confidentiality and security of their account credentials, including username and password.
  7. Users agree to comply with all applicable provisions of the Information Technology Act, 2000 and any other relevant laws and regulations.

Disclaimer of Warranty

 As-Is Basis:

    1. The use of this website/MGroup (MultiGroup)’s services is at the user’s sole risk. The website and its services are provided on an “as-is” and “as-available” basis.
    2. MGroup (MultiGroup) makes no representations or warranties of any kind, express or implied, regarding the website, its content, or the services provided.
  2. No Warranty of Accuracy:
    1. MGroup (MultiGroup) does not warrant the accuracy, completeness, or reliability of any information, content, or materials provided on the website or its services.
    2. MGroup (MultiGroup) reserves the right to modify or remove content without prior notice.
  3. No Warranty of Availability:
    1. MGroup (MultiGroup) does not guarantee uninterrupted or error-free access to the website or its services. The website may be temporarily unavailable due to maintenance, system malfunctions, or other reasons.
    2. MGroup (MultiGroup) is not responsible for any loss or damage resulting from the unavailability of the website or its services.
  4. No Warranty of Security:

    2. MGroup (MultiGroup) is not liable for any loss or damage resulting from unauthorized access to user accounts or data.
  5. No Endorsement of Third-Party Content:
    1. MGroup (MultiGroup) does not endorse, warrant, or guarantee the accuracy or legality of content posted by third parties on the website.
    2. Users are responsible for evaluating the reliability of third-party content and should use caution and common sense when accessing or relying on such content.
  6. Users’ responsibility
    1. The Users are ultimately responsible for choosing and/or interacting with other Users on the website and MGroup (MultiGroup) is only a facilitator that shall not be held responsible or liable for the selection and/or interaction of the Users with others on the website.
    2. The Users understand and agree that any interactions and associated issues with the other Users and/or the third parties with whom the Users interact through the website or the third party whose services the Users avail through the website could require execution of separate agreement and User agrees to execute the same.

5. Limitation of Liability

To the fullest extent permitted by law, MGroup (MultiGroup) disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall MGroup (MultiGroup) be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or use, arising out of or in any way connected with the use of the website.

  1. MGroup (MultiGroup) does not guarantee the accuracy, completeness, or legality of property listings, and we disclaim any responsibility for any errors or omissions.
  2. MGroup (MultiGroup) does not guarantee the availability, quality, or suitability of any properties listed on the website.
  3. Users acknowledge that property listings may be subject to errors and omissions.
  4. MGroup (MultiGroup) shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our website, the delay or inability to use our website, or for any information obtained through our website.
  5. Users agree that MGroup (MultiGroup) is not responsible for any disputes between buyers and sellers, and any claims or damages arising from such disputes shall be the sole responsibility of the parties involved.
  6. Users acknowledge that MGroup (MultiGroup) is not responsible for the actions of users or the content of property listings.
  7. MGroup (MultiGroup) is not responsible for monitoring or controlling the actions or conduct of users on the website. MGroup (MultiGroup)’s role is limited to providing a platform for property listings, and it does not endorse or guarantee the accuracy, legality, or quality of user-generated content. MGroup (MultiGroup) shall not be liable for any damages or losses incurred as a result of the actions or conduct of users on the website.
  8. MGroup (MultiGroup) employs security measures to protect electronic records and electronic transactions. However, users acknowledge that no online system can guarantee absolute security.

Notwithstanding anything to the contrary, in no event shall the total liability of MGroup (MultiGroup) and its affiliates, officers, directors, employees, agents, and third-party service providers exceed the amount paid by you, if any, for accessing or using the website.

6. Intellectual Property

Content

  1. All content and materials displayed on this website, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, and data compilations, are the property of MGroup (MultiGroup) and/or its licensors or its content suppliers and are protected by intellectual property laws. Users shall not use, reproduce, or distribute the content without MGroup (MultiGroup)’s prior written consent.
  2. Users are granted a limited, non-exclusive, non-transferable license to access and use the content for personal and non-commercial purposes. Any unauthorized use, reproduction, or distribution of the content is strictly prohibited.

Trademarks

  1. All trademarks, service marks, and logos displayed on the website are the property of MGroup (MultiGroup) or their respective owners.
  2. Users are prohibited from using any trademarks, service marks, or logos without the express written permission of MGroup (MultiGroup) or the owner of the respective mark.

User-Generated Content

  1. By submitting or uploading any content to the website, including but not limited to property listings, reviews, comments, or any other information (“User-Generated Content”), users grant MGroup (MultiGroup) a worldwide, royalty-free, irrevocable, non-exclusive, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display the User-Generated Content in connection with the operation of the website and the promotion of the MGroup (MultiGroup)’s services.
  2. Users represent and warrant that they have the right to grant the above license for any User-Generated Content submitted.

7. Data Protection and Privacy

MGroup (MultiGroup) shall retain electronic records of transactions and communications for a reasonable period as required by applicable laws.

MGroup (MultiGroup) respects your privacy, and all data collected for providing the services or for promotional purposes will be handled in accordance with our Privacy Policy and applicable law. 8. Use of Information

MGroup (MultiGroup) warrants that the acquisition, retention, utilization, and dissemination of all data, including User information, pursuant to this Agreement, shall consistently comply with the provisions of the Information Technology Act 2000, its associated regulations, and other pertinent applicable laws, both during the term of the services and upon termination or expiration of the agreement with the User.

The User hereby grants irrevocable and unconditional authorization to MGroup (MultiGroup) for the following purposes:

  1. Provisioning of services as per the terms of this agreement;
  2. Disclosure of User information to its directors, officers, employees, advisors, auditors, legal counsel, or authorized representatives as necessary for the provision of Services;
  3. Liaison with third party service providers and/or facilitating/enabling the services of such third-party service providers for the User, as per the arrangement between MGroup (MultiGroup) and such third-party service provider;
  4. Conducting internal analyses, consumer surveys, and generating reports related to the services;
  5. Registering an account or receiving notifications, and contacting property sellers/buyers;
  6. Sending notifications, contact details, promotional messages, and promotional calls either directly by MGroup (MultiGroup) or through its partners/vendors and sub-partners/sub-vendors;
  7. Disclosure of personally identifiable information to third parties (including law enforcement agencies) where MGroup (MultiGroup) has reasonable grounds to suspect the User of engaging in any unlawful conduct.

Third-Party Services

MGroup (MultiGroup) shall, as per User’s request and necessity, engage directly or indirectly the services of third-party service providers to deliver the services to Users, in accordance with separate terms and conditions agreed upon between MGroup (MultiGroup) and such third-party service provider.

9. Notices and Communication by MGroup (MultiGroup)

  1. Users agree to receive notices, updates, and communications from MGroup (MultiGroup) electronically. Notices will be sent to the email address provided during registration or through other electronic means. Users are responsible for maintaining accurate and up-to-date email addresses and ensuring that communications from MGroup (MultiGroup) are not blocked or flagged as spam.
  2. MGroup shall not be held liable or responsible in any manner under law or equity for any unauthorized transactions made without following the process established by MGroup and communicated to the user via emails, online terms and conditions or otherwise. It is the user’s responsibility to be aware of the legitimate manner of making relevant payment for the services displayed on the Platform.
  3. Unauthorized Transactions shall include but be not limited to user making any payments to an entity or to a source not explicitly authorised or communicated by MGroup in writing.

Promotional Communication

By using this website, you implicitly consent to receiving promotional and marketing communications from MGroup (MultiGroup) through various communication channels, including but not limited to email, SMS, and other electronic means.

MGroup (MultiGroup) may use the contact information provided by you during registration or account setup for the purpose of sending promotional communications related to the MGroup (MultiGroup)’s products, services, updates, and special offers. You have the right to opt-out of receiving promotional communications at any time by reaching out to us via the ‘Contact us’ tab.

MGroup (MultiGroup) may collaborate with third-party partners for marketing initiatives. In such cases, your contact information may be shared with these partners for the purpose of sending relevant promotional communications.

 10. Indemnity

You agree to indemnify and hold harmless MGroup (MultiGroup), its associates, partners, its affiliates, officers, directors, employees, agents, and third-party service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with: (i) Your use of the website and its services; (ii) Your violation of these terms and conditions or any applicable laws; (iii) Your infringement or violation of any third-party rights, including intellectual property rights; (iv) Any content you submit, post, or display on the website; and/or (v) Any transactions or interactions with other users of the website.

MGroup (MultiGroup) reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. In such a case, you agree to cooperate with MGroup (MultiGroup)’s defence of such claims.

11. Compliance with laws

  1. Users agree to comply with all applicable laws and regulations in connection with their use of the website and any property transactions.
  2. MGroup (MultiGroup) may cooperate with law enforcement authorities and disclose information as required by law.

12. Governing Law & Jurisdiction

These terms and conditions, and any disputes arising out of or related to the use of the website, shall be governed by and construed in accordance with the laws of India.

Any legal action or proceeding arising out of or related to these terms or the use of the website shall be brought exclusively in the courts of New Delhi. By using the website, you consent to the exclusive jurisdiction and venue of these courts. Users agree to waive any objection to the jurisdiction and venue of the courts specified above and agree not to plead or claim in any court that such action or proceeding has been brought in an inconvenient forum. If you access the website from a jurisdiction other than you are responsible for compliance with any local laws, and to the extent permitted by applicable law, you consent to the exclusive jurisdiction and venue of the courts above.

13. Termination

By the User

Users have the right to terminate their account on the website at any time by following the account closure process. Upon termination by the user, the user’s access to the website and related services will cease.

By MGroup (MultiGroup)

MGroup (MultiGroup) reserves the right to terminate or suspend a user’s account and access to the website at its discretion, with or without cause, and without prior notice.

Grounds for termination by MGroup (MultiGroup) may include, but are not limited to:

  1. Violation of these terms and conditions.
  2. Violation of applicable laws or regulations.
  3. Conduct that MGroup (MultiGroup), in its sole discretion, deems harmful to other users, the website, or its business interests.

Effect of Termination

Upon termination of the user’s account, the user will lose access to all features and services provided by the website. MGroup (MultiGroup) is not liable to the user or any third party for the termination of the user’s account.

Survival of Certain Provisions

Termination of the User’s account or User’s access to the Website does not affect the continued applicability of certain provisions, including but not limited to, intellectual property rights, indemnification, and limitation of liability, which shall survive the termination.

MGroup (MultiGroup)’s right to cease operations

MGroup (MultiGroup) reserves the right to cease the operation of the website or its operation at any time, in its sole discretion. In such cases, users will be notified in advance, if possible. MGroup (MultiGroup) shall not be liable to users or any third party for the cessation of operations.

14. Knowledge of real estate laws

  • For the purposes of this agreement and the provision of services herein, it is deemed that Users possess awareness regarding the rules and regulations pertaining to the Real Estate Regulatory Authority (RERA) of the relevant state in India. MGroup (MultiGroup) advises Users to periodically consult the pertinent RERA website for updates and information concerning any property listed on the website, prior to consummating any transaction or agreement.
  • MGroup (MultiGroup) neither endorses nor advertises any property listed on the website, and shall not bear liability for the inclusion of any property on its platform that violates the regulations prescribed under the RERA of the respective state. Moreover, Users are not to infer any affiliation or association between MGroup (MultiGroup) and the parties listing their properties on the website.

15. Changes to Terms

MGroup (MultiGroup) reserves the right to update, modify, or amend these terms and conditions at any time, without prior notice. Any changes to these terms will be effective immediately upon posting on the website. Users are encouraged to review the terms regularly to stay informed about any updates. Your continued use of the website after any such changes constitutes acceptance of those changes.

16. Waiver & Severability

Waiver: The failure of either party to enforce any provision of this agreement shall not be construed as a waiver of such provision or any other provision herein. Any waiver must be in writing and signed by the party granting the waiver.

Severability: If any provision of this agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. The parties agree to negotiate in good faith to replace any such provision with a valid, legal, and enforceable provision that achieves, to the extent possible, the original intentions of the parties.

17. Customer Support

MGroup (MultiGroup) provides customer support to address user inquiries, concerns, and feedback. Users may contact the customer support team through the contact details provided on the website. The customer support team is available during regular business hours to assist users with general inquiries and technical support related to the use of the website.

Customer support will endeavour to address and resolve user grievances in a timely manner, in accordance with the applicable laws and regulations. Users are encouraged to provide detailed information about their grievances to facilitate a prompt and effective resolution.

Customer support will acknowledge the receipt of grievances and provide a response within the timeframes stipulated by the relevant laws. In the event of dissatisfaction with the resolution provided, users may escalate the matter to the Grievance Officer in accordance with the applicable laws.

18. Grievance Officer

Users may contact the Grievance Officer for any grievances, complaints, or concerns related to the content posted on the website, violation of these terms and conditions, or any other issues.

19. Declaration

MGroup (MultiGroup) shall not be held liable or responsible in any manner under law or equity for any unauthorized transactions made without following the process established by MGroup (MultiGroup) and communicated to the user via emails, online terms, and conditions or otherwise. It is the user’s responsibility to be aware of the legitimate manner of making relevant payment for the services displayed on the Platform.

Unauthorized Transactions shall include but be not limited to user making any payments to an entity or to a source not explicitly authorised or communicated by MGroup (MultiGroup) in writing.
